Introduction

The Online Shop at ZAZA ATELIER.com is a service of ARTERY Ltd. provided solely for customers’ personal use for the sale of lingerie. Access to and use of this Website and the products and services available through this Website are subject to the following terms, conditions and notices.

ZAZA ATELIER has taken great care to ensure that the Items on its website are presented as accurately as possible. However, colour clarity will depend upon customers’ own personal monitors and ZAZA ATELIER therefore cannot guarantee that the colour of the actual Item is absolutely accurate. Customers should read through these Terms before placing an order.

To be eligible to purchase Items on this Website customers must:
1. Be the holder of a valid debit/credit card.
2. Warrant that the personal information, which customers are required to provide when placing an order is true, accurate and current in all respects.
Customers agree not to impersonate any other person or entity or to use a false name or a name that the customer is not authorized to use. By using this site customers agree to comply with, and be bound by, these Terms. ZAZA ATELIER may from time to time change these Terms at its sole discretion. By using this Website after any such change(s), customers agree to comply with, and be bound by, the Terms as changed.

Making A Purchase

When a customer orders an Item from ZAZA ATELIER the customer is offering to buy it for the price stated, subject to these Terms. The customer will be guided through the process of placing an order by a series of instructions on the Website. The customer places an order for Items from the Website by completing the online order process. Once a customer has placed an order, they will receive an email from ZAZA ATELIER, acknowledging the exact details of the order.

Unless ZAZA ATELIER notifies the customer that their order has not been accepted, or the customer has cancelled their order in accordance with the Returns policy set out below, NJAL’s acceptance of the customer’s order and the completion of the contract between the customer and ZAZA ATELIER will take place when the customer receives an email from ZAZA ATELIER confirming the Items they have ordered.

ZAZA ATELIER’s acceptance of the customer’s order will be deemed complete and received by the customer at the time and date of sending of the email, which time and date is specified on the email. The deemed time and date of receipt by the customer shall apply regardless of whether, for reasons outside ZAZA ATELIER’s control, the customer has not received that email.

ZAZA ATELIER may not accept a customer’s order if:
1. An item the customer has ordered is out of stock,
2. ZAZA ATELIER is unable to obtain authorization for the customer’s payment or,
3. If ZAZA ATELIER identifies a product or pricing error. ZAZA ATELIER reserves the right to reject any offer to purchase by a customer at any time and at the sole discretion of ZAZA ATELIER.

If ZAZA ATELIER is unable to fulfil a customer’s order following ZAZA ATELIER’s order acknowledgement, ZAZA ATELIER will contact the customer by email or telephone advising them of this. See the Returns policy set out below. ZAZA ATELIER will try to keep its Website as up to date as reasonably possible but cannot guarantee that any particular Item will always be available. If ZAZA ATELIER can’t supply any Item it will release the funds being held in the customer’s account for the purchase.

Coupon Discounts

Discounts may be offered to selected customers at ZAZA ATELIER’s complete discretion. Discount privileges may be withdrawn at any time in relation to any Order that has not been acknowledged.

Payments

ZAZA ATELIER takes all reasonable care to make its Site secure. ZAZA ATELIER does not store customers’ credit card details on its systems, however all other details will be fully encrypted and only used to process the order which the customer has initiated.
Furthermore, ZAZA ATELIER will take all reasonable care, in so far as it is in its power to do so, to keep the details of customers’ orders and payments secure, but in the absence of negligence on ZAZA ATELIER’s part, ZAZA ATELIER cannot be held liable for any loss the customer may suffer if a third party procures unauthorized access to any data the customer provides when accessing or ordering from the Site.

Credit Cards

The customer’s credit card company may undertake an additional security check to confirm it is the customer making the order. ZAZA ATELIER will retain the legal ownership of the Items until full payment has been made by the customer, and such payment has been received by ZAZA ATELIER. Legal ownership of the Items will immediately revert to ZAZA ATELIER if it refunds any such payment to the customer. Risk in the Items will pass to the customer on delivery to them.

Shipments

ZAZA ATELIER aims to deliver the customer’s chosen items to the place and person of their choice, in perfect condition and in the shortest possible time. 

Please order from ZAZA ATELIER with enough lead-time to prevent any loss or disappointment resulting from the delivery time, as ZAZA ATELIER cannot be responsible for this.

The default processing time frame for In Stock items is usually up to 3 working days.

The delivery times are dependent on when the order is processed and on the customer’s location. ZAZA ATELIER operates Monday to Friday excluding UK public holidays and orders are not processed outside of this time frame. Estimated delivery times are to be used as a guide only and commence from the date the order is processed. ZAZA ATELIER is not responsible for any delays caused by any local customs clearance processes.
If the customer’s order cannot be delivered within the timeframe specified at the time the order is placed, ZAZA ATELIER will notify the customer and try to rectify the situation as quickly as is practically possible. All new orders are deemed separate and each is treated individually.

Dispatch

Please note that ZAZA ATELIER aim to dispatch all orders within 3 working days, excluding bank holidays. ZAZA ATELIER is not responsible for any delays caused by any local customs clearance processes.

Returns

Please note that we do not accept returns of our products due to hygienic reasons. If an item is defective, the customer must contact ZaZa atelier at zaza.atelier.underwear@gmail.com to receive a full refund for the defective items.

Tax & Duties

If the customer orders goods for delivery outside of the EU, please note that the customer’s purchase may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by the customer. It is accepted by the customer that ZAZA ATELIER have no control over additional charges in relation to customs clearance. ZAZA ATELIER recommends that the customer checks with their local customs officials or post office for more information regarding importation taxes/duties that may be applicable to their online order.

Insurance

ZAZA ATELIER insures each purchase during the time it is in transit until it is delivered to the customer’s specified delivery address. ZAZA ATELIER requires a signature for any goods delivered, at which point responsibility for the customer’s purchased goods passes to the customer. If the customer has specified a recipient who is not themselves for delivery purposes (for example as a gift) then the customer accepts that evidence of a signature by this recipient (or at that delivery address) is evidence of delivery and fulfilment by ZAZA ATELIER and transfer of responsibility in the same way.

Force Majeure

ZAZA ATELIER shall have no liability to the customer for any failure to deliver goods they have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Copyright & Trademarks

All content available on the Website, including, but not limited to, text, graphics, logos, button, icons, images, audio clips, data compilations, and software, and the compilation thereof (the “Content”) is the property of Artery Ltd., its partners or its licensors, and is protected by international copyright laws.

The trade marks, logos, and service marks displayed on the Website (collectively, the “Trade Marks”) are the registered and unregistered marks of Artery Ltd., its licensors or its partners and are protected by international trade mark laws. All or any other trade marks not owned by Artery Ltd., its affiliates, its partners or its licensors that appear on the Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Artery Ltd..

Neither the Content, the Trade Marks, nor any other portion of the Website may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in full or in part, for any purpose without Artery Ltd.’s prior written consent.

Entire Agreement

These terms and conditions, together with the current ZAZA ATELIER website prices, delivery details and ZAZA ATELIER contact details, set out the whole of the agreement relating to the supply of the goods to customers by ZAZA ATELIER. These terms and conditions cannot be varied except in writing signed by a director of ZAZA ATELIER.

Governing Law

Customers’ use of this Website and any purchase by them of any Item from ZAZA ATELIER shall be governed by Bulgarian law and the customer hereto submits to the exclusive jurisdiction of the Bulgarian courts.
